These Terms and Conditions set out the basis on which Rubbish Clearance Wimbledon provides waste collection and rubbish clearance services to consumer and business customers. By booking a collection, you agree to be bound by these Terms and Conditions, so please read them carefully before placing an order.

1. Definitions and Interpretation

In these Terms and Conditions, the following words have the meanings given:

Service means any rubbish clearance, waste removal, waste collection, loading, transportation, sorting, recycling or disposal service that we provide.

We, us, our means Rubbish Clearance Wimbledon, the waste collection service provider.

You, your means the person or business requesting and paying for the Service.

Site means the property or location where the Service is to be carried out.

Waste means the materials you ask us to remove, including household, garden, construction, commercial or other non-hazardous waste, subject to these Terms and applicable waste regulations.

Contract means the agreement between you and us for the provision of the Service, as set out in these Terms and any written confirmation we issue.

2. Scope of Service

We provide rubbish clearance and waste collection services, including but not limited to domestic and commercial waste removal, bulky item clearance, garden waste removal, and general rubbish clearance. The exact scope of the Service for each booking will be as described in your quotation or booking confirmation.

The Service includes labour to load your Waste onto our vehicle, transportation of the Waste from the Site, and handling, sorting, recycling or disposal at licensed facilities in accordance with applicable UK waste legislation.

We reserve the right to refuse to collect any Waste that is hazardous, prohibited, incorrectly described, unsafe to handle, or not in line with applicable waste regulations or our licence conditions.

3. Booking Process

3.1 You may request a Service by telephone, email, online form or other booking method we make available. You will be asked to provide details of the type and approximate volume or weight of Waste, access arrangements to the Site, and your preferred dates and time windows.

3.2 Any quotation we give, whether verbally or in writing, is based on the information you provide. Quotations are estimates only and may be adjusted if the actual nature, volume, weight or handling requirements of the Waste differ from your description.

3.3 A booking is not confirmed until we accept it and issue a booking confirmation, which may be provided verbally or in writing. The Contract comes into existence when we confirm your booking.

3.4 Where we provide a two-hour or similar arrival window, this is an estimate and not a guaranteed time. We will use reasonable efforts to attend within the agreed window but cannot accept liability for delays due to traffic, weather, access restrictions or other circumstances beyond our reasonable control.

4. On-Site Assessment and Changes

4.1 Upon arrival at the Site, our team will assess the Waste, access, loading conditions and any health and safety considerations. If the Waste is greater in volume or different in type from that originally described, or if there are unforeseen access difficulties, we may revise the price or decline to carry out part or all of the Service.

4.2 If the price needs to be revised, we will explain the reasons and give you the option to accept the revised price or to cancel the Service at that point. If you cancel at the Site after we have attended, a call-out or cancellation charge may apply as set out in these Terms.

5. Waste Types and Prohibited Items

5.1 You are responsible for accurately describing the Waste and ensuring that it is suitable for collection under these Terms. You agree that you will not present any waste that is classified as hazardous or requires special handling unless we have expressly agreed in writing to accept such waste and you have complied with any additional conditions we specify.

5.2 Without limitation, we may refuse to collect or handle asbestos, clinical or medical waste, chemicals, solvents, oils, pressurised containers, gas bottles, paint, batteries, explosives, radioactive materials or any other items that we consider hazardous or unsuitable for normal rubbish clearance services.

5.3 If prohibited or undisclosed hazardous items are included with the Waste and not identified before loading, you will be responsible for any additional costs, fines, penalties or liabilities incurred by us as a result, including costs of safe handling, storage, treatment and disposal.

6. Access and Site Responsibilities

6.1 You must ensure that we have safe, lawful and reasonable access to the Site at the agreed time. This includes providing any necessary permissions, codes, keys, parking arrangements and clear pathways to the Waste.

6.2 You are responsible for ensuring that the Site is safe and suitable for our staff to work at, and that the Waste is accessible, reasonably consolidated and not contaminated with sharp, dangerous or unsafely stored items.

6.3 If we are unable to carry out the Service, in full or in part, due to access issues, safety concerns, or incorrect information provided by you, we may charge a wasted journey or cancellation fee to cover our costs.

7. Prices and Payment

7.1 Our prices are typically based on the volume and type of Waste removed, the labour involved, access conditions, and any additional services required. We may also apply minimum load charges or call-out fees.

7.2 Unless otherwise stated, all prices are in pounds sterling and may be inclusive or exclusive of VAT, as specified at the time of booking or on your invoice.

7.3 Payment is due in full on completion of the Service, unless we agree alternative credit terms in writing before the Service is carried out. We accept common payment methods such as cash, card payment or bank transfer, as notified to you at the time of booking.

7.4 For business customers with agreed credit terms, invoices must be paid within the period stated on the invoice. We reserve the right to charge interest and reasonable debt recovery costs on late payments in accordance with applicable UK late payment legislation.

8. Cancellations and Amendments

8.1 You may cancel or amend your booking by contacting us using the details provided in your booking confirmation. Cancellations or amendments must be made as early as possible.

8.2 If you cancel more than 24 hours before the scheduled arrival time, no cancellation fee will usually apply. If you cancel within 24 hours of the booked arrival time, we may charge a reasonable cancellation fee to cover our costs, including any allocated vehicle and crew time.

8.3 If our team has already been dispatched or has arrived at the Site, and the Service cannot proceed due to cancellation, access issues or reasons within your control, we may charge a call-out fee or a proportion of the estimated Service cost.

8.4 We reserve the right to cancel or reschedule a booking at any time due to operational reasons, vehicle breakdown, staff sickness, extreme weather, safety concerns, regulatory issues or other events beyond our reasonable control. Where possible, we will notify you and offer an alternative date or time. We will not be liable for any indirect or consequential loss arising from such cancellation or rescheduling.

9. Customer Cooperation and Conduct

9.1 You agree to cooperate with our staff and provide any information reasonably required to complete the Service safely and efficiently.

9.2 You must not abuse, threaten or harass any member of our team. We reserve the right to withdraw our staff and terminate the Service immediately if they experience abusive or unsafe behaviour at the Site. In such cases, a cancellation or call-out charge may still apply.

10. Title, Recycling and Disposal

10.1 Once Waste is loaded onto our vehicle and payment is made or agreed in accordance with these Terms, title to that Waste passes to us and we will be responsible for its onward handling, subject to applicable waste regulations.

10.2 We are committed to responsible waste management and will aim to reuse, recycle or recover materials wherever reasonably practicable, in line with the waste hierarchy and UK environmental legislation.

10.3 All waste handling, transport, treatment and disposal will be carried out using licensed facilities and in compliance with relevant environmental, duty of care and waste carrier regulations.

11. Liability and Limitations

11.1 We will exercise reasonable care and skill in providing the Service. However, we will not be liable for any damage to property arising from pre-existing defects, poor construction, hidden services, or conditions that could not reasonably have been foreseen by our staff.

11.2 You should remove or protect any items or surfaces that may be susceptible to damage during normal loading and carrying operations, such as delicate flooring, walls, fixtures or furnishings. We will not be responsible for cosmetic damage that occurs as a result of normal and careful performance of the Service in areas where waste must be moved through tight or restricted spaces.

11.3 Our total liability to you in respect of any claim arising out of or in connection with the Service or these Terms, whether in contract, tort or otherwise, will be limited to the amount paid or payable for the specific Service giving rise to the claim, except where such limitation is not permitted by law.

11.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited under UK law.

11.5 We will not be liable for any loss of profits, business interruption, loss of goodwill, loss of opportunity, or any indirect or consequential losses arising out of or in connection with the Service, even if we have been advised of the possibility of such losses.

12. Your Responsibility for Waste

12.1 You are responsible for ensuring that the Waste collected belongs to you or that you have the authority of the owner or occupier of the Site to arrange its removal.

12.2 You must not include any items in the Waste that you wish to retain. Once removed and loaded onto our vehicle, items will not usually be retrievable. We accept no responsibility for items mistakenly included in the Waste.

12.3 You remain responsible for complying with your legal duty of care in relation to the Waste until it is collected by us. We will provide our waste carrier details upon request so that you can demonstrate compliance with this duty.

13. Compliance with Waste Regulations

13.1 We operate as a registered waste carrier and will comply with all applicable UK and local waste management and environmental regulations, including the proper handling, transportation and transfer of Waste to authorised facilities.

13.2 Where required by law, we will complete any necessary waste transfer documentation, including descriptions of the Waste and details of both parties. You agree to provide accurate information needed for any such documentation.

13.3 We may refuse to collect Waste if doing so would breach any applicable law, permit condition or regulatory requirement. In such circumstances, we will inform you of the reason and, where possible, suggest alternative lawful options, but we will have no obligation to accept such Waste.

14. Events Beyond Our Control

14.1 We will not be in breach of these Terms or liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. This may include but is not limited to extreme weather, accidents, traffic disruption, civil unrest, strikes, vehicle breakdowns and regulatory or safety requirements.

14.2 Where such an event occurs, we will use reasonable efforts to contact you, minimise disruption and, where possible, rearrange the Service within a reasonable time.

15. Personal Data

15.1 We will collect and use your personal data only for the purposes of administering your booking, providing the Service, processing payments, managing our relationship with you and, where permitted, sending you relevant service information.

15.2 We will handle personal data in accordance with applicable UK data protection laws. You have rights in relation to your personal data, including rights of access and correction, which you may exercise by contacting us using our published contact details.

16. Variations to These Terms

16.1 We may update or amend these Terms from time to time to reflect changes in our services, business operations, pricing, or applicable laws and regulations.

16.2 The Terms that apply to your booking will be those in force at the time your Contract is formed, unless a change to the Terms is required by law or regulatory authority, in which case the updated Terms may apply to existing Contracts.

17. Governing Law and Jurisdiction

17.1 These Terms and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of England and Wales.

17.2 You and we agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service.

18. General Provisions

18.1 If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be removed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

18.2 No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that or any other right or remedy, nor shall any single or partial exercise preclude any further exercise.

18.3 You may not transfer or assign any of your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations to another organisation as part of our business operations, provided this does not materially affect your rights under the Contract.

18.4 These Terms, together with your booking confirmation and any agreed written variations, constitute the entire agreement between you and us in relation to the Service and supersede any previous understandings or representations.
